Largo, FL 4-Plex Fire

This 4-plex apartment building, located in Largo, FL, sustained serious damage to one of its units as a result of a kitchen fire. The fire department responded quickly to ensure the fire was contained to one unit. Even so, the fire gutted the kitchen and caused substantial water and smoke damage throughout the unit.

After initial inspections with the independent adjuster assigned by Citizens to handle the claim, within one week the insured was given an estimate and “final” offer to settle in the amount of $29,000 which included loss of rents. This was substantially lower than the claim proposal amount presented by Fabbro & Company of around $65,000. Good faith efforts to work with the Citizens field adjuster to reach a compromise were unsuccessful, forcing the insured to demand Appraisal to resolve the differences. When Appraisal was requested, terms were presented by Citizens that were unreasonable forcing the insured to retain counsel to file for a declaratory judgment on the issue. Within weeks of filing the action, the claim was settled for $56,500, or nearly 100% above the initial “take it or leave it” offer by Citizens Property Insurance Corporation.
